Girls Gone Wild Plantiff Gets A New Trial (Updated)
LatestLast July, a jury ruled that because a woman danced in a club, she’d consented to her breasts being forcibly exposed in Girls Gone Wild Sorority Orgy, despite saying no and signing no consent form. Thankfully, there’s some good news.
That would be the fact that a judge has ordered a new trial — and we’ve got a copy of his order. To recap:
The woman, identified only as Jane Doe, was dancing in at the former Rum Jungle bar in 2004 when someone reached up and pulled her tank top down, exposing her breasts to the “Girls Gone Wild” camera. Jane Doe, who was 20 at the time the tape was made, is now living in Missouri with her husband and two children. She only found out about the video in 2008, when a friend of her husband’s saw the “Girls Gone Wild Sorority Orgy” video and recognized her face.
She promptly sued Girls Gone Wild for $5 million, but the St. Louis jury foreman summed up the subsequent verdict by saying, “Through her actions, she gave implied consent. She was really playing to the camera. She knew what she was doing.”
We’re informed by Jane Doe’s legal counsel that the very reasonable Judge John J. Riley has ordered a new trial. From his order:
